Legal bases for the matcha pack contest
1. IDENTIFICATION OF THE ORGANIZING COMPANY
The organizing company, Replantea Nature, SL, with registered office at Avda. Andalucía, 53 2, 18300 Loja (Granada), and CIF B72673171, is organizing a raffle with prizes in accordance with current laws. The raffle with prizes is subject to these terms and conditions.
"User" means any person who accesses this website and participates in the prize draw. Users agree to strictly comply with these Terms and Conditions and all other applicable laws and regulations, as applicable.
2. PURPOSE OF THE DRAWThe prize draw aims to thank and reward customer loyalty.
3. TERRITORIAL SCOPE
The draw is valid in the Peninsula and the Balearic Islands.
4. PARTICIPATION REQUIREMENTS
Participation in the prize draw is open to adults (18 years or older) residing in the valid area (see clause 3), who must have a valid Instagram account and meet the following conditions:
- Follow @replanteaeco on Instagram
- Like the corresponding post.
- Mention 2 friends in the post.
5. DURATION AND TEMPORAL SCOPE
The contest begins on January 26, 2024, and ends on February 5, 2024, at 11:59 PM. Interested users may participate until the closing date. The winner will be notified via Instagram direct message on the first business day following the end of the indicated contest period.
6. NATURE OF THE DRAW
Participation in the contest is free. However, only users who meet the eligibility requirements will be eligible.
7. PRIZE
The prize for this contest consists of a Replantea Matcha Starter Pack for three different winners. The prize may not be substituted, compensated, or modified in any way at the request of the winning participant, and is not transferable or redeemable for cash. Participants may waive their prize, but no alternative prize will be offered. Furthermore, such waiver will not be compensable or give rise to compensation. The organizing company has the right to request the winner to present their ID or other official identification. The transfer of the right to receive the prize is prohibited.
8. PROCEDURE FOR AWARDING THE PRIZE
The contest will be conducted through the AppSorteos platform and is a completely random contest. Winners authorize the organizing company to publish their Instagram handle on Replantea Nature, SL's Instagram social network. All participants must comply with these legal conditions and refrain from posting comments in the contest that violate or are likely to violate morality, ethics, public order, any fundamental rights, or intellectual and industrial property rights. In the event of such practices, the organizing company may file a complaint, delete the comment, and block the participant. In the event that the comments harm or damage third parties, the organizing company will not be liable for such damages, and the offending participant will be held responsible in all cases.
9. METHOD OF CONTACT WITH THE WINNER
Contest winners will be notified via private message on Replantea Nature SL's official Instagram account (@replanteaeco). Replantea will also post stories on its official Instagram account, where the winners' names and/or usernames will be mentioned. Winners must respond and accept the message within 3 days of receiving it. If the winner does not respond or forfeits the prize within this period, the drawing will be repeated. The prize will also be redrawed in the event of a winner's disqualification.
10. DISQUALIFICATION OF THE PARTICIPANT
If a participant fails to comply with these legal terms or makes comments that harm, violate, or are likely to undermine morality, ethics, public order, the fundamental rights of citizens, or intellectual or industrial property rights, they will be disqualified from the contest and will not be able to participate. The company may also disqualify a participant if it becomes aware that they have commented on the contest post on matters that harm or violate the rights of third parties.
11. FRAUD
If a participant uses a fake profile or registers with a profile that is not their own, or that of a third party without their consent, said participant will be disqualified from the contest and will forfeit the prize if they are the winner after the drawing.
12. DISCLAIMER OF THE ORGANIZING COMPANY
The organizing company, Replantea Nature, SL, is exempt from any liability in the event of malfunctions in social media or other applications that impede the normal operation of the contest. The organizing company will not be liable for data loss or problems in the transmission of participant data that are not attributable to the company itself. It will also not be liable in cases where there are errors in participant data that prevent their identification. Should participants make comments or engage in practices that harm, infringe upon, or violate the rights of third parties, the organizing company will be exempt from any liability. Likewise, the organizing company will be exempt from any liability should participants use a fake profile or engage in any fraudulent practices.
13. EXEMPTION AND DISCONNECTION FROM INSTAGRAM
The social network Instagram is completely exempt from any liability for each contestant or participant. Furthermore, Instagram does not sponsor, endorse, or administer this contest in any way and is not associated with it. Participants disconnect completely from Instagram and provide their information to the organizing company, Replantea Nature, SL, and not to Instagram. The information provided to the organizing company will be used exclusively to manage user participation and, if a user wins, to contact them and communicate the prize.
14. ACCEPTANCE OF THE LEGAL BASES
Participation in this contest implies full acceptance of these legal terms and regulations. If a participant does not accept these legal terms and conditions, they will be excluded from the contest. The winner, after expressing their consent and accepting the prize, assumes all costs incurred, including the costs of prize retrieval and use, except for those expressly included in the contest. Any costs voluntarily covered by the organizing company are excluded. Furthermore, the winner will be responsible for taxes and any other costs arising from this contest.
15. INTELLECTUAL PROPERTY
The organizing company reserves the right to use the Instagram username without explicit notification.
16.PROTECTION OF PERSONAL DATA
In compliance with data protection regulations, we inform you that the personal data provided by participants to the organizing company will be included in a database owned by Replantea Nature, SL. These data will be processed and used for the purpose of participating in the contest and naming the future winner. If you wish, you may exercise your rights of access, rectification, opposition, and deletion of your data at any time by writing to the data controller at the email address indicated below: hola@replantea.es
